These terms

Undertow is made and run by Subcult. In these terms, "we" means Subcult and "Undertow" means the editor at this address, its accounts, its API and its cloud rendering. By using Undertow you agree to these terms. If you do not agree, do not use it.

The privacy policy explains what we store and why.

Who can use it

You must be at least 13 years old. If you are under the age at which you can agree to a contract where you live, a parent or guardian must agree for you. To buy a subscription you must be old enough to enter into that purchase.

What is free and what is paid

Accounts and API keys

Your content

The files you bring and the videos you export belong to you or to whoever licensed them to you. We claim no ownership of them.

You are responsible for having the rights you need to use everything you put in a video, including the song, artwork, video clips, fonts and lyrics, and for how you publish the result.

To run the service we need to handle some of your content. You give us permission to store your project layouts and preview images, and to copy, process and store the files you upload for a cloud render, only so we can save your projects and produce and deliver your video.

Acceptable use

Do not use Undertow to:

If you believe something stored on or rendered by Undertow infringes your copyright, write to [email protected]. Say what the work is, where the material is, and how to reach you. We will look into it and remove material where that is warranted.

The Creator subscription

Rendering on your own device stays free whether or not you subscribe.

Open source

Undertow's source code is published under the GNU Affero General Public License, version 3. That license, not these terms, governs what you may do with the code. These terms cover your use of the service we run at this address.

The visualizer presets were written by the Milkdrop community and are provided through Butterchurn. Fonts bundled with the editor are licensed under the SIL Open Font License.

Other services

Stripe handles payments, and Google handles sign-in if you choose it. Your use of those services is subject to their terms. Supporting Subcult on Patreon is separate from Undertow and is governed by Patreon's terms.

Changes and availability

We may add, change or remove features, and the service may be unavailable at times for maintenance or because something has failed. We will try to give notice before removing something you rely on. Keep your own copies of your media and of any project you cannot afford to lose; you can download a project's layout from the Project menu.

Ending your use

You can stop using Undertow at any time and delete your account under Account, Delete account. Cancel any subscription first.

We may suspend or close an account that breaks these terms or puts the service or other people at risk. Where we can, we will tell you why and give you a chance to fix it. If we close a paid account for a reason other than a breach of these terms, we will refund the unused part of the current period.

No warranty

Undertow is provided "as is" and "as available". To the extent the law allows, we make no promises about it, including that it will be uninterrupted, free of errors, or fit for a particular purpose, or that exported videos will meet the requirements of any platform you publish them on.

Limit of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for lost profits, lost data or lost business, arising from your use of Undertow. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose, or 50 US dollars if that is more.

Nothing in these terms limits liability that cannot be limited by law, or takes away consumer rights you have where you live.

Disputes and governing law

If you have a complaint, write to [email protected] first. We will try in good faith to resolve it. Applicable law governs these terms, without limiting any mandatory consumer protections that apply where you live.

Changes to these terms

When these terms change, we update the date at the top. If a change is significant, we will tell account holders by email or in the editor before it takes effect. If you keep using Undertow after a change takes effect, you accept the new terms. If you do not accept them, stop using Undertow and cancel any subscription.
